1 – Preamble

These General Terms of Use (hereafter referred to as ”GTU”) are designed to determine the guidelines for provision and use of the content and services of the web site www.symbiosys.com (hereafter referred to as the ”Website”) between the company BIOCODEX SAS (hereafter referred to as ”BIOCODEX”) and the internet user (hereafter referred to as the ”User”).

Access to the Website and its content, as well as the use of the services offered by the Website, implies that the User accepts these GTU without exception. Since the GTU can be modified at any time and without prior notice, the User is invited to consult them regularly.

3 – Purpose of the Website and access to services

The Website was designed to present and promote SYMBIOSYS® brand food supplements marketed by BIOCODEX.

The Website is accessible anywhere and to any User with an internet connection. All the expenses involved in accessing the Website (computer hardware, software, internet connection, etc.) are the responsibility of the User.

The Website enables the User to access the following services:

  • general information on the microbiota and products;
  • news articles and tips (blog);
  • a collection of testimonies;
  • a tool for finding points of sale;
  • access to the online store;
  • subscription to the newsletter;
  • a contact form.

BIOCODEX uses all the tools at its disposal to ensure high-quality access to the Website and to its services. However, this is an obligation of means and not of result: the User thus agrees not to claim any compensation from BIOCODEX and their suppliers, in the event that the Website is not available at the time when the User wishes to access it.

Access to the Website and its services can, at any time and without prior notice, be interrupted, suspended or changed, for maintenance purposes or for any other reason.

The User can contact BIOCODEX by e-mail, using the contact form made available.

 

4 – Responsibilities

In accordance with the legislation in force, food supplements marketed by BIOCODEX are declared to the French General Directorate for Competition, Consumer Affairs and Fraud Control (DGCCRF).

Taking a food supplement should not replace a varied and balanced diet and a healthy lifestyle.

Any information provided on the Website relating to well-being is presented for information purposes only. This information does not claim to cover all aspects of well-being and nutrition. The User uses the Website under his sole responsibility. In particular he acknowledges and agrees not to rely on the information it contains to make decisions regarding his health or possible medical treatment without the advice of a health professional.

BIOCODEX endeavors to provide quality, verified information. However, information sources cannot be completely guaranteed.

Any ”outbound” links present on the Website enable the User to access information and other complementary resources available on the internet, or to share information on social networks. BIOCODEX has no means of controlling the content of these completely independent third-party sites and, as such, cannot be held responsible for the consequences of accessing these third-party sites and their content.

 

5 – Intellectual Property

The Website, as well as all the elements which comprise it (such as brands, logos, text, photographs, databases, etc.) are the exclusive property of BIOCODEX or its suppliers, and are protected by the Intellectual Property Code.

The User agrees to use the content of the Website in a strictly private context. Any partial or complete reproduction of the Website or of one of its parts, on any medium or format, for any other purposes and particularly for commercial purposes, without written authorization from BIOCODEX, is prohibited.

 

6 – Data protection

BIOCODEX is aware of the importance of protecting personal data and is committed to processing data concerning the User on the Website in compliance with the General Data Protection Regulation (GDPR) and the modified French Data Protection Act.

The User can freely browse the present Website without having to provide personal information. Nevertheless, he may use the contact form and may subscribe to the newsletter.

Purpose and legality of processing
BIOCODEX allows the User to subscribe to the Website’s newsletter.
The legal basis for processing is the User’s consent.
The User may unsubscribe from the newsletter (withdraw his consent) at any time on the Website or thru the unsubscribe link in the newsletter he has received.

Any User wishing to receive the newsletter on the email address they have provided.

The above information is provided by the User. It is mandatory to allow the User to receive the Website’s newsletter.

Managing cookies

What is an internet cookie and what does it do?

BIOCODEX uses cookies to improve the User’s experience, generate audience statistics and optimize browsing on the Website.
The legal basis for processing is the execution of a contract: the User’s acceptance of these GTU. Nonetheless, some types of cookies are generated via consent from the User.

Security of personal data

BIOCODEX takes all the necessary precautions to preserve the security of the User’s personal data and particularly tries to prevent this data from being deformed or damaged and to prevent unauthorized third parties from having access.

BIOCODEX uses HTTPS protocol on the Website. This security mechanism enables the User to verify the identity of the Website being accessed, thanks to an authentication certificate issued by a third-party authority esteemed to be reliable. It also helps to guarantee the confidentiality and integrity of the data sent by the User, such as the information entered in the contact form.

 

Rights of individuals

In accordance with the applicable regulations concerning the protection of natural persons with regard to the processing of personal data and on the free movement of such data1, the User may at any time exercise his right of access and obtain a copy of the data concerning him, request its rectification or erasure, request the limitation of the processing or the portability of its data, oppose to the processing2.

If, after contacting BIOCODEX, he considers that its rights concerning its data have not been respected, the User can send a complaint to the local supervisory authority of its country.
